Please read these Terms carefully. By accessing or using the InfoClass platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.

1Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and InfoClass ("InfoClass", "we", "us", or "our"), the operator of the InfoClass school management platform accessible at InfoClass and via our Android application.

By registering for, accessing, or using the InfoClass platform in any manner, you confirm that:

  • You have read, understood, and agree to be bound by these Terms.
  • If you are accepting these Terms on behalf of an institution, you represent that you have the authority to bind that institution to these Terms.
  • You are at least 18 years of age, or are accessing the platform under the supervision of a school administrator.

2Description of Services

InfoClass provides a cloud-based school management platform ("Services") that enables educational institutions to manage:

  • Academic operations including timetables, attendance, examinations, and results.
  • Human resources and staff management.
  • Finance and fee tracking.
  • School announcements and internal communications.
  • Student information and performance records.

The Services are provided on a subscription basis to registered institutions. We reserve the right to modify, suspend, or discontinue any feature of the Services at any time, with reasonable notice to affected users.

3Eligibility & Registration

The InfoClass platform is designed for use by registered educational institutions operating in India. To access the Services, the institution must:

  • Complete the registration process and provide accurate, current, and complete information.
  • Maintain the accuracy of registration information and update it promptly if it changes.
  • Designate at least one authorised administrator who is responsible for managing the institution's account.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at hello@infoclass.in if you suspect any unauthorised access to your account.

4Institutional Responsibilities

The institution ("Customer") using InfoClass is solely responsible for:

  • Ensuring that the use of InfoClass complies with all applicable laws and regulations, including the Digital Personal Data Protection Act, 2023.
  • Obtaining all necessary consents from students, parents/guardians, and staff before entering their personal data into the platform.
  • The accuracy, legality, and appropriateness of all data uploaded or entered into the platform.
  • Managing user access levels and promptly revoking access for individuals who are no longer associated with the institution.
  • Ensuring that all authorised users of the platform comply with these Terms.
Data Responsibility: InfoClass acts as a data processor on behalf of the institution (data fiduciary). The institution bears responsibility for the lawful collection and use of personal data entered into the platform.

5Acceptable Use

You agree to use the InfoClass platform only for lawful purposes and in accordance with these Terms. You must not:

  • Use the platform for any unlawful, fraudulent, or malicious purpose.
  • Upload, transmit, or store content that is unlawful, defamatory, obscene, or that infringes the intellectual property rights of any third party.
  • Attempt to gain unauthorised access to any part of the platform or its underlying infrastructure.
  • Introduce viruses, malware, or any other harmful code into the platform.
  • Use automated scripts, bots, or scrapers to extract data from the platform without our express written consent.
  • Resell, sublicense, or otherwise commercialise access to the platform without authorisation.
  • Interfere with the security, integrity, or availability of the Services.

We reserve the right to suspend or terminate access immediately for any user or institution found to be in violation of these acceptable use requirements.

6Intellectual Property

All rights, title, and interest in and to the InfoClass platform — including but not limited to software, code, design, user interface, trademarks, logos, documentation, and content created by InfoClass — are and shall remain the exclusive property of InfoClass.

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for your institution's internal school management purposes.

Your Data: You retain all ownership rights to the data you upload or generate within the platform ("Customer Data"). You grant InfoClass a limited licence to process Customer Data solely for the purpose of providing and improving the Services.

You must not copy, modify, reverse engineer, decompile, or create derivative works based on any part of the InfoClass platform without our prior written consent.

7Subscription & Payment

Access to InfoClass is provided on a subscription basis. The following terms apply to all paid plans:

  • Fees: Subscription fees are as agreed in the order form or pricing plan selected at the time of sign-up. All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (including GST).
  • Billing: Fees are billed in advance on the applicable billing cycle (monthly or annually). Invoices will be sent to the registered email address of the institution's administrator.
  • Late Payment: Failure to pay fees when due may result in suspension of access to the Services. Access will be reinstated upon receipt of all outstanding amounts.
  • Refunds: Subscription fees are generally non-refundable except where required by applicable law. Any refund requests must be submitted to hello@infoclass.in within 7 days of billing.
  • Price Changes: We reserve the right to revise our pricing with 30 days' prior written notice to your registered email address.

8Data & Privacy

Your use of the InfoClass platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you acknowledge and agree to the collection and use of information as described therein.

Upon termination of your subscription, we will retain your data for a period of 90 days during which you may request an export. After this period, your data will be permanently and securely deleted from our systems, except where retention is required by law.

9Disclaimer of Warranties

Important: The InfoClass platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, InfoClass expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.
  • Any warranty regarding the accuracy, reliability, or completeness of any content or data on the platform.

We do not warrant that the Services will meet your specific requirements or that any errors will be corrected. Your use of the platform is at your sole risk.

10Limitation of Liability

To the maximum extent permitted by applicable Indian law, InfoClass and its directors, employees, agents, affiliates, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Any damages resulting from unauthorised access to or alteration of your data.
  • Any damages arising from the conduct of third parties using the platform.

In any case, our total aggregate liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the total fees paid by your institution to InfoClass in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such cases, our liability is limited to the maximum extent permitted by law.

11Indemnification

You agree to indemnify, defend, and hold harmless InfoClass (InfoClass), its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services in violation of these Terms.
  • Your breach of any applicable law or regulation.
  • Any data you upload, store, or transmit through the platform.
  • Any claim by a third party arising from your institution's use of the Services.

12Termination

By the Institution: You may terminate your subscription at any time by contacting us at hello@infoclass.in. Termination will take effect at the end of the current billing period, and no refunds will be issued for any unused portion of a prepaid subscription.

By InfoClass: We reserve the right to suspend or terminate your access to the Services, with or without notice, if:

  • You breach any provision of these Terms.
  • Payment is overdue for more than 30 days.
  • We are required to do so by law or a court order.
  • Continued provision of the Services poses a security or legal risk.

Effect of Termination: Upon termination, your right to access the platform ceases immediately. We will retain your data for 90 days following termination, after which it will be permanently deleted.

13Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Dispute Resolution: In the event of any dispute arising out of or in connection with these Terms or the Services, the parties shall first attempt to resolve the dispute through good-faith negotiations. If the dispute is not resolved within 30 days, it shall be referred to arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996 of India.

  • The seat of arbitration shall be India.
  • The arbitration shall be conducted in the English language.
  • The award of the arbitrator shall be final and binding on the parties.

Nothing in this clause prevents either party from seeking interim or injunctive relief from a court of competent jurisdiction.

14Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the Effective Date at the top of this page.
  • Notify institutional administrators via email or an in-platform notification at least 14 days before the changes take effect.

Your continued use of the InfoClass platform after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use of the Services before the effective date.
